As a buyer of a Fusion Private Club LLC membership I understand and agree to the following:
1. For Contract Agreement based membership, I understand that at the end of my contract, my contract will stay at the same low rate but convert to the terms of the month-to-month membership and I will be charged the amount stated according to these terms on a monthly basis until I cancel by sending an email to "

". or a letter to Fusion Private Club 100 7th Street, #707, Pittsburgh, PA 15222. (phone requests are not allowed).
2. For Contract Agreements I understand that with the length of the contract in months, only paid months are counted toward the total required months of membership. Unpaid months and months on suspension do not count toward my total months of membership required by the contract.
3. I authorize Fusion Private Club LLC to initiate debit of membership dues to my credit card or checking account provided. I understand that the monthly dues will be debited from my account each month on my membership anniversary date.
4. I authorize Fusion Private Club LLC to charge my credit card for fees for Events for which I register.
5. Fusion Private Club LLC may charge a fee of $10 if the credit card supplied is denied.
6. 'Showing up' to an event without pre-registering at least one hour before the event starts is subject to availability, and may result in an $5 on-site registration service charge in addition to the cost of the event; unless otherwise noted in the event.
7. I agree that any pictures taken of me during any event hosted by Fusion Private Club LLC or any authorized agent of Fusion are the sole property of Fusion and may be used by for promotional purposes.
8. I agree to abide by the rules of Fusion Private Club LLC as outlined. Fusion Private Club LLC reserves the right to alter these rules.
9. My membership is not transferable.
Contract Agreement Cancellation Policy
The Contract Agreement may not be cancelled and must be paid in full except under the following conditions:
Three-Day Right of Rescission - You, the buyer, may cancel this agreement, without any penalty or obligation, at any time prior to midnight of the original contract seller's third business day following the date of this contract, excluding Sundays and holidays. " at www.fusionprivateclub .com which states that you, the buyer, are canceling this agreement, or words of similar effect. This notice shall be sent to: Fusion Private Club LLC, 100 7th Street, #707 Pittsburgh, PA 15222.
Moving - Should the member move more than 90 miles from Fusion Private Club, using 100 7th Street, Pittsburgh PA 15222 as the central point, a member may cancel this contract by notifying Fusion Private Club LLC in writing and by providing proof of the move in the form of a PA (or applicable state) Driver’s License, utility bill, or bank statement mailing. Under this cancellation, the member will be obligated to pay Fusion Private Club the difference between the amount paid to date and the amount that would have been paid under a month-to-month contract, plus a fee of $25.
Serious Injury or Death - Upon serious injury or death of a member, the estate will not be obligated to pay the remaining portion of the contract.
Early Termination of Contract - If a member wishes to cancel their membership before their contract has been fulfilled and does not meet any of the above exceptions, they may still do so but will incur a penalty fee of $150.
Membership Suspension
Members are allowed to suspend their membership for up to 3 months during a 12 month period. During suspension, members will only be charged $5 per month of suspension that is to be paid up front at the start of suspension. During suspension, members will not be allowed to register for events. Suspension ends when the time expires or when a member logs into the member portal and manually ends the suspension. There is no refund for suspension months not used. If a member is under contract during suspension, their contract will be extended for the number of months the member was in suspension.
Credit Card Charge backs
Any charge backs received through a member or former member filing of credit card disputes on a transaction found to be valid by the processing agency will result in a $25 service charge for each dispute. An escalation of the dispute on a charge, which is again found to be valid by the credit card processing agency will result in a $200 service charge.
I acknowledge and agree that I have read the foregoing and understand the nature of the activities at Fusion Private Club LLC. I agree to all the terms of this agreement and acknowledge I have read it and the membership policies.
EVENTS CANCELLATION POLICY
Members are responsible for canceling their own registrations online. We will offer our assistance to aid you in your effort to find a replacement. All event refunds are issued to a "Member's Tab" and are NOT put back in to the member's bank account or credit card. The members tab is always used to pay event fees when registering for future events. The member's tab may not be used to pay membership dues.
The cancellation policy is designed to help us lower event costs to members. Advance planning allows us to negotiate with vendors and make commitments in exchange for extra benefits and lower costs.
To better serve our members, each event has its own time frames for cancellation deadlines and the amounts of refund, rather than a general "one size fits all" rule. Some events will have a 100% refund guarantee up until the time of the event, others may have No refund possibility. Check the event cancellation policy shown when you register for the event.
Here are three sample cancellation possibilities:
1. You cancel from an event. If we cannot find a replacement for you, your refund for that event will be given as follows:
a. 7 days or more in advance of the event will result in no penalty and you will receive 100% off the cost of the event will be credited to your membership account.
b. 3 to 7 days in advance of the event will result in a penalty of 50% of the cost of the event, and thus a 50% refund of the cost of the event will be credited to your membership account.
c. 72 hours or less will result in a penalty of 100% of the cost of the event.
2. You cancel from an event, and we find a replacement for you off a waiting list:
a. The same policy as above applies, but with a maximum penalty of $40.
3. You cannot attend an event, but you find another member to take your place.
Please let the Event Coordinator in charge of the event know that you are sending someone in your place. In this case, the charge you incurred for the event will stand, and the person taking your place would reimburse you directly for the event.
EXAMPLE: For example, you sign up for a river rafting trip at a cost of $100. You decide 48 hours in advance that you cannot go on this trip. If you find your own replacement, they would reimburse you directly. If you rely on us to find a replacement, and we cannot, your original charge of $100 will not be refunded. However, if we can replace you, you will get a credit of $60 to your account.
Should your membership with Fusion Private Club LLC stop for any reason, any credit balance you have with Fusion Private Club LLC will be forfeited and not returned to your personal accounts or credit cards.
The cancellation policy does not necessarily apply to trips where more severe penalties for cancellation may be outlined on the calendar and descriptions.

RELEASE OF LIABILITY
For your convenience, this Release of Liability form shall apply to any and all Fusion Private Club LLC events and activities.
Release of Liability
This is a Release of Liability. Please read carefully before signing. Signing this form is a pre-condition to participation in an event.
1. I have been advised by Fusion Private Club LLC of certain activities or events that are planned by and/or through Fusion Private Club LLC. The particular activities are set forth in the monthly calendar on the Fusion Private Club LLC website.
2. I acknowledge that my participation in an event or activity, use of Fusion Private Club LLC facilities or my use of any equipment or machinery during the activity may result in risk or injury or death to myself and/or damage to my personal property. I acknowledge that before participating in each event, I have exercised my own diligence to learn about the risks. I have taken said risks into consideration, as well as the state of my own health, in making my decision to participate.
3. I am aware that there are inherent risks in all activities and that unpredictable events may occur. My participation in such activities is voluntary on my part.
4. I understand that I may choose to carpool to or from Fusion Private Club LLC events either in my own vehicle or as a passenger in another vehicle. Though Fusion Private Club LLC may organize these carpools, I understand that use of them is not required. I agree that I am choosing to carpool solely under my own risk. If I am a driver, I will maintain insurance as required by law and as a passenger I will ensure that the driver of any car I am in maintains a current insurance policy. I acknowledge that participation in the carpool may result in death or injury to myself or to my personal property and that I will not hold Fusion Private Club LLC liable for any physical injury or property damage that may occur.
5. I hereby solely and expressly assume all of the said risks, and fully release and waive any claim I might have or state against Fusion Private Club LLC on whatever basis (including negligence, contract warranty, and/or bailment) as a result of any physical injury or property damage incurred by me in any activities or in use of transportation getting to or coming from an event.
6. I agree that any pictures taken of me during any event hosted by Fusion Private Club LLC or at the Fusion Private Club LLC Clubhouse are the sole property of Fusion Private Club LLC and may be used for promotional purposes.
7. This release shall be effective and binding upon the parties. By signing, I acknowledge having read and understood this release.
